The Administrative Office of the District Attorneys ("AODA"), under the supervision of the elected or appointed district attorneys of the State of New Mexico, provides authorized defense counsel and approved defense representatives access to discovery materials through the eProsecutor Portal ("Portal") for the purpose of supporting the facilitation of criminal discovery and assisting in the fulfillment of applicable disclosure obligations in criminal proceedings pursuant to Rule 5-501 NMRA, applicable constitutional obligations including Brady v. Maryland, and other applicable New Mexico law governing criminal discovery.
By registering for or accessing the Portal, you acknowledge that you have read, understood, and agree to comply with these Terms of Use.
Discovery materials accessed through the Portal are confidential criminal justice records intended solely for authorized use in connection with representation in the associated criminal matter and do not constitute public records or public disclosure under state or federal public records laws. Users shall not disclose Portal credentials, permit unauthorized access, or disseminate discovery materials except as authorized by applicable law, court order, or protective order.
Users shall not use information obtained through the Portal to harass, threaten, intimidate, improperly contact, or otherwise interfere with victims, witnesses, law enforcement personnel, or other persons involved in a criminal proceeding.
Discovery materials made available through the Portal may expire, be modified, supplemented, or removed after a designated access period. Defense counsel is solely responsible for timely downloading, securely storing, and maintaining all necessary discovery materials.
All Portal activity may be logged and monitored, including logins, downloads, uploads, file access history, timestamps, and IP address information. Unauthorized access, misuse, dissemination, or attempted circumvention of Portal security may result in suspension or termination of access, referral to the court, referral to professional disciplinary authorities, and/or criminal investigation or prosecution.
AODA and the applicable district attorney reserve the right to modify these Terms of Use and Portal access requirements at any time consistent with applicable law and court rules.
